I guess there must be clauses in the contract between ToCs and ROSCOs» about incidents such as this? While the ROSCO owns the stock and therefore has a vested financial interest, it clearly has no part in the maintenance and operation of it. In this case, I guess the damage will be repaired and the unit put back into service. But in event of a vehicle being written off, things maybe start to get rather complicated?
And then there's the manufacturer, Alstom. As I understand it, the contract was to build and maintain the units.
