A man who left a railway trespasser with life-changing injuries after throwing a 2kg lump of concrete at his head has been jailed.

Robert Sandall, 35, and of Cotswold Close, Oldbury, was found guilty of GBH without intent at Birmingham Crown Court on 28th March, following an incident in 2017.

On 16th April the Judge sentenced him to a total of four years in prison.

On 11th August 2017, the 20-year-old victim was trespassing on the lines in the Washwood Heath area of Birmingham with three friends.

The group admitted they had been throwing stones towards nearby business premises.

The court heard that Sandall, who worked at a nearby recycling facility, took the law into his own hands and made his way to a railway bridge where he waited for the young men to return.

Standing on the bridge he then launched a 2kg missile of concrete at the group who were on the tracks below, hitting the victim on top of the head and causing catastrophic injuries which left him on life-support for four days.

He continues to require rehabilitation and will suffer life-long effects from his head injury.

Correct to jail him, but shouldn't he get a croiminal record as well? Discuss.

He does get a criminal record as he has been found guilty of a crime

indeed - hence suggesting a simple criminal record, rather than a jail sentence

You can't get a criminal record without being found guilty of a crime. That means going to court, whether magistrate's or crown, and the CPS may well have decided that in this case it's not in the public interest. His three accomplices might well have criminal records now, we're not told.
